Terms Of Service Regarding Kana Fuyuko's Copyright Usage

(Terms Updated On: July 29th, 2023)December 20th, 2021 was when Kana Fuyuko as the intellectual property was approved for copyright under the U.S. Copyright Office. When it comes to using the character, Kana Fuyuko, whether it may be the branding or imagery that depicts the character, the person who wishes to use the character must follow and respect the following conditions, failure to do so may result in a DMCA strike. We state the following for legal reasons and we use the term "may" meaning that there may be certain circumstances that are permitted depending on the case of the event or a DMCA notice is rejected depending on what is being reported.The following usages are NOT permitted with the Kana Fuyuko intellectual property (Again, failure to comply "may" result in a DMCA strike):-NO Commercial Use: You shall not use Kana Fuyuko's image to sell merch or receive any monetary gain like donations, ad revenue, or sales unless given permission. The only exceptions without permission are collab videos/streams where Kana is presented or if an artist was officially commissioned by Kana Fuyuko herself.

-NO NSFW/Pornography: Regarding NSFW usage of Kana Fuyuko, due to a certain rule on the internet, while technically it's permitted to draw/create NSFW of Kana Fuyuko, HOWEVER, you MUST obey the following when making NSFW of Kana Fuyuko (Failure to obey "may" result in a DMCA strike):(NOTE ANY NSFW IMAGES OF KANA FUYUKO ARE NEVER OFFICIAL!!! DO NOT HARASS KANA FUYUKO OR ANY NSFW ARTIST FOR ALLOWING CERTAIN NSFW WORKS!!! ESPECIALLY DO NOT SEXUALLY HARASS KANA FUYUKO WITH NSFW IMAGES OF HER!!! Let's be respectful regarding NSFW stuff.)-You are NOT allowed to use official renders or artwork used by Kana Fuyuko herself to make NSFW imagery as this may cause others to mistake the supposed parody work to be official (This also includes videos and stream VODs/screenshots which includes Kana Fuyuko's image).
-You MUST credit Kana Fuyuko in the image whether via tags or posting at least one social media link directing to Kana Fuyuko depending on the site (MAKE SURE TO STATE IT'S A FAN ART AND NOT OFFICIAL!).
-You are NOT allowed to spam the NSFW image on other sites and pass off the image as official to "blackmail" or "misrepresent" the Kana Fuyuko brand (A NSFW artist is allowed to share NSFW images of Kana Fuyuko for portfolio reasons).
-You MUST state (Depending on the site) that the image is a parody and that it's not an official work of Kana Fuyuko to avoid confusion between parody work and the official work of Kana Fuyuko to avoid legal issues.
-You are NOT allowed to include any offensive or illegal actions (Refer to U.S. Laws) in the NSFW images, even if it's drawn, we take serious actions to protect the branding of Kana Fuyuko.
-If the NSFW image is 3D, the 3D model of Kana Fuyuko MUST NOT replicate any official 3D models (Including previous 3D models) created by Kana Fuyuko herself to avoid confusion between official and parody works (Basically try to make your work distinctive from the original, which defines "parody").
-You are NOT allowed to include Kana Fuyuko with any friends or people that Kana Fuyuko has worked with or collabed with in the NSFW image. This can be very disrespectful to both parties if involved.Note: If you are reporting NSFW images of Kana Fuyuko to the copyright holder, please verify if the image breaks any of the rules above before reporting. Also please don't direct message the NSFW images of Kana Fuyuko to Kana Fuyuko herself unless given permission for DMCA purposes.

-Derivative Works Notice: If you are making a character inspired by Kana Fuyuko, please make sure that the character is not an exact replica of Kana Fuyuko herself and that the character is seen as separate from Kana Fuyuko very clearly. If you purposely claim the Kana Fuyuko brand or pass off official renders as your own you may receive a DMCA strike.

-Education/Research Purposes: You are allowed to feature Kana Fuyuko's character or even official tutorials created by Kana Fuyuko on your content. You are NOT allowed to repost the full content of any of Kana Fuyuko's tutorials, videos, or streams VODs. You are only allowed to include small snippets of the original content.

If you do wish for Kana Fuyuko to see the art, please make sure you ask Kana Fuyuko for permission in direct messages, again it's not recommended to message Kana Fuyuko NSFW of herself.

If for any reason however there is an issue you wish to address with Kana Fuyuko, please email [email protected] so we can handle the issue/problem you have regarding Kana Fuyuko privately and we will get it resolved as fast as possible, do avoid posting your issue publically to avoid any further escalation.
